Terms of Service

01 Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and xyox ("XO", "we", "us") covering your use of the XO Discord bot, its website, and any paid plan (together, the "Service"). By inviting XO to a Discord server, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you are accepting these Terms on behalf of a company, organisation, or community, you confirm you have the authority to bind that party, and "you" means that party.

02 What XO Is

XO is a third-party software bot that monitors a Discord server and, once the server owner has explicitly enabled it, reacts to destructive events such as mass channel deletion, mass role deletion, rapid bans and kicks, webhook spam, and join raids. Depending on the plan and configuration it can quarantine members, remove known malicious bots, seal the server, and rebuild it from a layout it recorded beforehand.

XO is not affiliated with, endorsed by, or sponsored by Discord Inc. Discord is a trademark of Discord Inc. XO is an independent tool that operates only through the permissions a server owner voluntarily grants it, and only while it is invited to that server.

XO is a best-effort safety tool. It reduces damage. It does not eliminate it. Section 4 is the part most people should read twice.

03 Your Responsibilities

You are responsible for the server XO protects, and you agree that:

• You are the server owner, or you act with the server owner's authority, for every server where you add XO.
• You keep your own backups. XO is a protection tool, not a backup service, and its automatic backup is a separate premium feature you must set up yourself.
• You comply with the Discord Terms of Service and Community Guidelines in your server.
• You review what you enable. XO only acts on channels, roles and features you or the server owner deliberately bind, and only after protection is activated.
• You keep the bot's role above the roles it manages, and you do not remove Administrator from XO while relying on it to undo damage.

04 No Guarantee of Protection

Protection depends on conditions outside our control, including:

• Discord's own systems — API latency, event ordering, gateway delivery, rate limits, and outages on Discord's side.
• Your permissions — if XO lacks the permission it needs for a given action, it cannot take that action.
• Network and hosting — the bot can be offline, restarted, rate limited, or unreachable, including through no fault of ours.
• The attack itself — a sufficiently large, fast, or well-timed attack can outrun detection, and some damage may be done before the first event reaches XO.
• Your configuration — a lockdown, quarantine, or restore only works if the relevant channels, roles, and settings are bound and still intact when it is needed.

A partial response is still a partial response. XO may seal a server, quarantine members, or rebuild a layout and still fail to restore everything exactly, including original names, positions, overwrites, webhooks, messages, threads, forum posts, application commands, and any content Discord no longer retains.

We are not liable for any loss or damage arising from a nuke, raid, or destructive event that XO did not stop, did not fully stop, was unable to stop, or was prevented from acting on. This applies whether the event was carried out by a user, a bot, a compromised account, a moderator, an administrator, or anyone else.

If our bot token is compromised

XO runs on a bot token held on our own infrastructure. If that token is leaked, stolen, scraped from a log, or otherwise obtained by a third party, that person can take control of XO — including using it to delete channels, roles, and other content on every server it is in. We are telling you this plainly because you would otherwise have to find out during an incident.

We cannot guarantee this will never happen, and we cannot fully prevent it while the bot is running. Keeping a token secret is an ongoing obligation for us, not a promise we can make, and a compromise may only become known after damage has already been done. There is therefore a chance that a leaked token results in XO performing a nuke, or damage equivalent to one, on your server.

Where damage is caused by a compromised or leaked token, we are not liable for that damage or for any loss arising from it, on the same basis as section 5.

What we do commit to: we revoke and reissue the token as soon as a compromise is reported to us, we announce suspected compromises in our support server, and we keep no token in a file, repository, or log that we control. Your side of it is short and worth taking — remove XO from your server the moment you suspect a compromise, which ends its access immediately, then tell us in the support server named in section 14. Do not wait for us to notice: a leaked token keeps working until the session is ended or the token is revoked.

05 Limitation of Liability

To the maximum extent permitted by law, XO and its operators, contributors, and affiliates are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, nor for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or connected to your use of, or inability to use, the Service.

We are also not liable for:

• Deleted, altered, or unrecoverable channels, roles, messages, threads, forum posts, webhooks, emojis, stickers, or server settings.
• Lost channel or role positions, hierarchy, or permission overwrites that are not restored exactly.
• Lost server level, boosts, Nitro perks, verification requirements, or community features.
• Members who leave, are banned, or are wrongfully quarantined because of XO's actions.
• Any decision you make on the basis of XO acting, or failing to act.
• Any failure, delay, or interruption of the Service, including planned maintenance.
• Actions taken by Discord, by other bots, or by any third party.

Our total aggregate liability for any and all claims arising out of or relating to the Service is limited to the greater of the amount you paid us for the Service in the twelve (12) months before the event giving rise to the claim, or [US $50 / EUR 50]. On a free plan, where you have paid nothing, that amount is zero.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

06 Automated Actions

XO acts automatically once activated. It may remove roles, restrict permissions, seal channels, quarantine or remove members and bots, and delete the decoy channels you asked it to create. You are responsible for reviewing what it is set up to do before you switch it on.

Automated protection is not perfect judgement. False positives happen. If XO acts wrongly, stop it — remove it from the server or run .xodeactivate to hand permissions back — and report what happened. You accept that we are not liable for the consequences of an action XO took automatically, even where that action was wrong.

07 Backups and Your Data

XO records a layout of your server so it can attempt a rebuild after a destructive event. That record is a working snapshot for restoration, not an archival backup, and it may be incomplete or out of date.

Automatic off-site backup is a separate premium feature and is never switched on for you. If you want it, you buy it and you set it up yourself. We are not liable for lost data that a backup you did not take would have saved. The /autobackup command exists to tell you the feature is premium and to stop there.

We store the settings, bindings, and snapshots needed to run the Service. We do not require access to your messages, and we do not sell your data. See the Privacy Policy for detail on what is stored.

08 Premium Plans and Payments

Some features are paid. Where we take payment:

• Fees are charged as described on the pricing page, in advance, for the period you select.
• Payments are processed by our payment provider. We do not store your full card details.
• You may stop renewal at any time; access continues until the end of the period you have paid for.
• All payments are final and non-refundable. Once a plan is paid for it is not refunded — not if XO is unavailable, not if a feature changes or is discontinued, not if you are suspended under section 12, and not if you simply stop using it. Nothing here is a refund promise; the only exception is where the law of your jurisdiction gives you a right to a refund that cannot lawfully be excluded.
• Prices and included features may change. We will give reasonable notice before a change affects a plan you have already paid for.

Buying a plan does not create a guarantee of any outcome. Premium features are tools that improve your odds; they are not insurance and they are not a promise that damage will be prevented or repaid. No plan tier changes the liability limits in section 5.

09 Acceptable Use

You agree not to use the Service to:

• Raid, harass, threaten, discriminate against, or retaliate against any person, server, or community.
• Attack another server, or use XO as part of a raid or nuke tool, offensive or defensive.
• Violate Discord's Terms of Service or Community Guidelines, or any applicable law.
• Interfere with the Service or its infrastructure, including flooding, scraping, exploiting, or overloading it.
• Reverse engineer, decompile, resell, or redistribute the Service, except to the extent that law expressly permits it.
• Attempt to ban evasion or to avoid enforcement applied for a breach of these Terms.

XO is a defensive tool. Using it, or paying for it, to harm someone else is a breach of these Terms and of Discord's rules, and we will act on it.

10 Availability and Changes

The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or available at any given time. We may modify, suspend, or discontinue any feature or the whole Service at any time, with or without notice, and we are not liable for any resulting loss.

Features described on the website, including the raid and nuke server list, are informational. We do not warrant the completeness or accuracy of any list, and names or links may change or disappear.

11 Indemnity

You agree to indemnify, defend, and hold harmless XO and its operators, contributors, and affiliates from and against any claim, demand, loss, or expense (including reasonable legal fees) arising out of or related to: your use of the Service; your breach of these Terms; your violation of Discord's Terms of Service; your violation of any law or the rights of a third party; or a claim brought by one of your server members arising from your use of XO.

12 Suspension and Termination

You may stop using the Service at any time, including by removing XO from your server. Removal ends XO's access immediately, and we cannot recover a layout snapshot for a server we are no longer in.

We may suspend or terminate access, with or without notice, if you breach these Terms, breach Discord's rules, abuse the Service, or create a risk of harm to other people or communities. Where a paid plan is terminated, fees already paid are non-refundable, subject only to the exception in section 8.

13 Changes to These Terms

We may update these Terms. The date at the top of this page shows when they last changed. Material changes will be announced in our support server and, where practical, in the bot's update log. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and remove XO from your server.

Questions about these Terms, or a problem with a server XO damaged, can be raised in our support server at discord.gg/Z3K3ny6Rxk. Please include the server id, the time, and what happened — that is usually enough to find the log.

Governing law. These Terms are governed by the laws of the European Union, without regard to conflict of law rules, and the courts of the European Union have exclusive jurisdiction, except where consumer law gives you the right to bring proceedings where you live.
